These Terms of Service ("Terms") apply when you use our websites, including www.weareknitters.com and its regional versions, and when you buy products from us. Please read them before placing an order.

1. About us

In these Terms, "we", "us" and "our" refer to Gocase Int Coöperatief U.A. "You" means the person using our websites or buying from us.

2. Scope

These Terms apply to all use of our websites and to every order you place with us, together with our Shipping Policy, Returns Policy and Privacy Policy.

If you are a consumer, nothing in these Terms limits the rights you have under the mandatory consumer protection laws of the country where you live. Where these Terms conflict with those laws, the laws prevail.

3. Your account

You are responsible for keeping your account details accurate and your password confidential, and for activity on your account unless it results from our fault.

4. Orders and how the contract is formed

Product descriptions and prices on our websites are an invitation to order. When you place an order, we send an email confirming that we have received it. The contract between us is formed when we confirm that your order has been accepted or dispatched.

We may decline or cancel an order before the contract is formed, for example if a product is out of stock, if there is an obvious pricing or description error, if we suspect fraud, or if the order appears to be for resale. If we cancel an order you have already paid for, we will refund you in full.

5. Prices, payment and taxes

Prices are shown in the currency of the website you order from. For deliveries within the European Union and the United Kingdom, prices include VAT. Delivery charges are shown at checkout before you pay.

For deliveries to other countries, including the United States, import duties, taxes or customs fees may apply. Unless we state at checkout that these are included, they are payable by the recipient.

Payment is taken when you place your order, through the payment methods shown at checkout. Price changes do not affect orders we have already accepted.

6. Delivery

We deliver to the countries listed at checkout. Estimated delivery times are set out in our Shipping Policy. If you are a consumer, risk in the products passes to you when you, or someone you nominate, receive them.

If your delivery is significantly late, please contact us. If you are a consumer in the EU or UK and we fail to deliver within 30 days or an agreed extended period, you may cancel the order and receive a full refund.

7. Right of withdrawal and returns

Consumers in the EU and UK. You have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period ends 14 days after the day you, or a person you nominate, receive the products; for an order delivered in several parts, it runs from receipt of the last part.

To withdraw, tell us clearly before the period ends, for example by email to info@weareknitters.com. You may use the model withdrawal form in the Annex, but you do not have to.

You must send the products back within 14 days of telling us, to the address we give you. You pay the direct cost of returning them unless we tell you otherwise. We will refund all payments received, including standard delivery costs, within 14 days of receiving your withdrawal notice, using the same payment method. We may hold the refund until we receive the products back or you provide proof that you have sent them. You may be liable for any reduction in value caused by handling the products beyond what is needed to check them.

The right of withdrawal does not apply to products made to your specifications or clearly personalised, or to digital content once you have started downloading or streaming it with your prior consent and your acknowledgement that you lose the right of withdrawal.

8. Faulty or incorrect products

We will supply products that match their description and are of satisfactory quality. If a product is faulty, damaged or not as described, contact us at info@weareknitters.com with your order number and, if possible, a photo.

Consumers have legal rights in relation to products that do not conform to the contract, including repair, replacement, a price reduction or a refund. These rights apply in addition to, and are not limited by, these Terms or our Returns Policy.

9. Digital products

If we sell digital products such as patterns or video tutorials, we grant you a personal, non-transferable licence to use them for your own non-commercial purposes. You may make items from our patterns, including items to give away, but you may not copy, share, resell or publish the patterns themselves.

10. Intellectual property

All content on our websites, including text, images, videos, patterns, designs, logos and the We Are Knitters name, is owned by us or our licensors. You may not copy, reproduce, distribute or use it for commercial purposes without our written permission.

11. Reviews, comments and other submissions

When you submit reviews, photos, comments, competition entries or other content to us, you grant us a non-exclusive, royalty-free, worldwide licence to use, edit, reproduce and publish that content in connection with our business. You confirm that you have the right to grant this licence and that your content does not infringe anyone else's rights or contain unlawful, offensive or misleading material.

We may moderate or remove content at our discretion. We do not pay for unsolicited ideas or suggestions, and we are not obliged to keep them confidential.

13. Acceptable use

You must not use our websites to:

• break any law or infringe anyone's rights, including intellectual property rights;
• harass, abuse, defame or discriminate against others;
• submit false or misleading information, or impersonate another person;
• upload viruses or other harmful code, or interfere with the security or operation of our websites; or
• scrape, crawl or collect data from our websites or about other users without our permission.

We may suspend or close your account if you seriously or repeatedly break these rules. This does not affect orders already accepted, unless the breach relates to them.

14. Third-party links and tools

Our websites may contain links to, or tools provided by, third parties. We do not control them and are not responsible for their content or practices. Your use of them is subject to the third party's own terms.

15. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, for losses caused by events outside our reasonable control, or, if you buy for business purposes, for loss of profit, revenue or business opportunity.

We do not guarantee that our websites will always be available, uninterrupted or error-free. Product colours may look slightly different on screen from the actual products.

Nothing in these Terms excludes or limits our liability where that would be unlawful, including liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence, for defective products under product liability law, or for your statutory consumer rights.

Subject to the paragraph above and to the extent permitted by applicable law, our total liability to you in connection with any order is limited to the amount you paid for that order.

16. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order applies to that order. Changes do not apply to orders already placed.

17. Complaints, governing law and disputes

If you have a complaint, please contact us first at info@weareknitters.com.

These Terms are governed by Dutch law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

Disputes will be heard by the competent court in the Netherlands. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and we may only bring proceedings against you there.

18. General

If any part of these Terms is found invalid or unenforceable, the rest remains in effect. If we do not enforce a right straight away, we can still enforce it later. If these Terms are translated, the English version prevails to the extent permitted by law.
